Grey area — no general statute/regulation expressly authorizes OR prohibits remote commissioning/notarization. The Notaries and Commissioners Act (SA 2013, c. N-5.5) and alberta.ca guidance are silent on video. Law Society of Alberta (permanent guidance): "The Law Society of Alberta does not set rules governing remotely executed or attested documents" — each notary/commissioner must confirm the receiving authority accepts remote execution, and "notaries and commissioners must not execute any document in a manner that would mislead someone as to how or where the document was executed. Notaries and commissioners should clearly indicate that a document was executed virtually or remotely where applicable." Court of King's Bench 2020 COVID notice permitted remote commissioning of affidavits for court use (current status of that notice: unverified). Permanent statutory remote witnessing exists for wills/enduring POA/personal directives via 2020 COVID-19-era amendments requiring lawyer involvement (Wills and Succession Act etc.) (unverified detail). Who can do it: notaries public (lawyers/students-at-law ex officio; appointed lay notaries) and commissioners for oaths — subject to acceptor's requirements. Fee rules: no statutory fee/cap — official FAQ: "there is no set fee for these services."
